Ancak \u00e7\u0131kabilecek\nbaz\u0131 sorunlardan bahsetmek, t\u00fcketicinin i\u015flemini yaparken daha ara\u015ft\u0131rmac\u0131\nolmas\u0131n\u0131 sa\u011flayacak, bu sayede de birikimlerini koruyabilecektir.<\/p>\n\n\n\n<p>\u0130kinci\nel gayr\u0131menkul sat\u0131n al\u0131m\u0131nda en b\u00fcy\u00fck risk, sat\u0131n al\u0131nacak konutun &#8220;aile\nkonutu&#8221; olmas\u0131 durumudur. Bu durumda T\u00fcrk Medeni Kanunu&#8217; nun 194. maddesi\ndikkate al\u0131nmal\u0131, md 194\/1: &#8220;E\u015flerden biri, di\u011fer e\u015fin a\u00e7\u0131k r\u0131zas\u0131\nbulunmad\u0131k\u00e7a, aile konutu ile ilgili kira s\u00f6zle\u015fmesini feshedemez, <em>aile konutunu devredemez<\/em> veya\naile konutu \u00fczerindeki haklar\u0131 s\u0131n\u0131rlayamaz&#8221; diyerek, di\u011fer e\u015fin devire\nr\u0131zas\u0131 oldu\u011funun belgelendirilmesini aramaktad\u0131r. Aksi halde sat\u0131n ald\u0131\u011f\u0131n\u0131z\nkonuta yerle\u015fmeyi beklerken, di\u011fer e\u015fin a\u00e7aca\u011f\u0131 &#8220;tapu iptal ve\ntescil&#8221; davas\u0131 ile y\u00fcz y\u00fcze gelme riskiniz vard\u0131r. Maalesef, bu yasal d\u00fczenlemenin, zaman zaman k\u00f6t\u00fcye kullan\u0131ld\u0131\u011f\u0131na\nve bilin\u00e7siz t\u00fcketicinin ma\u011fdur edildi\u011fine ili\u015fkin duyumlar al\u0131nmaktad\u0131r.<\/p>\n\n\n\n<p>Yeni\nin\u015fa edilen yap\u0131dan konut al\u0131m i\u015flemlerinde ise, genellikle g\u00f6r\u00fclen\n&#8220;y\u00fcklenicinin iflas\u0131 ve konutun tamamlanamamas\u0131&#8221; veyahut &#8220;vaad edilen\n\u00f6zellikleri ta\u015f\u0131mayan bir konutun al\u0131c\u0131ya teslim edilmesidir. <\/p>\n\n\n\n<p>\u0130skan\u0131\nal\u0131nmam\u0131\u015f bir gayrimenkul\u00fc sat\u0131n almak bir risk ise, halk aras\u0131nda\n&#8220;topraktan&#8221; denilen, hen\u00fcz in\u015faat\u0131 yeni ba\u015flam\u0131\u015f bir gayrimenkul\u00fc\nsat\u0131n almak t\u00fcketici i\u00e7in bin risk olu\u015fturmaktad\u0131r.<\/p>\n\n\n\n<p>\u00d6ncelikle\nk\u00fc\u00e7\u00fck \u00f6l\u00e7ekli bir m\u00fcteahhitin &#8220;kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi&#8221; ile yapt\u0131\u011f\u0131\nya da yapaca\u011f\u0131 bir binadan sat\u0131n al\u0131nacak bir gayrimenkul i\u00e7in t\u00fcketicinin\nald\u0131\u011f\u0131 en b\u00fcy\u00fck risk, binan\u0131n m\u00fcteahhit taraf\u0131ndan tamamlanamamas\u0131 riskidir. Bu\ndurumda, arsa sahibinin s\u00f6zle\u015fmenin feshi do\u011frultusunda mahkemeden karar\nalmas\u0131, m\u00fcteahhitin eksik b\u0131rakt\u0131\u011f\u0131 i\u015fler nedeni ile, m\u00fcteahhitten gayrimenkul\ndevralan ki\u015filere kar\u015f\u0131, &#8220;tapu iptal ve tescil&#8221; davas\u0131 a\u00e7mas\u0131\nriskidir. Maalesef hukuk \u00e7evrelerinde de \u00e7ok\u00e7a ele\u015ftirilen, t\u00fcketiciyi \u00e7ok\nma\u011fdur eden bir s\u00fcre\u00e7 ba\u015flamaktad\u0131r. Bu itibarla, hem ald\u0131\u011f\u0131 gayr\u0131menkul\u00fc arsa\nsahibine vermek zorunda kalan, hem de \u00f6dedi\u011fi bedeli &#8220;bat\u0131k&#8221;\nm\u00fcteahhitten almas\u0131 beklenen t\u00fcketici iki defa ma\u011fdur edilmektedir.
