Mevcut iptal davalar\u0131n\u0131n yakla\u015f\u0131k y\u00fczde 70\u2019i kanunla\u015fan ola\u011fan\u00fcst\u00fc hal kanun h\u00fckm\u00fcnde kararnameleri ile Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinden olu\u015fmaktad\u0131r. \u015eu anda Mahkemenin \u00f6n\u00fcnde anayasall\u0131k denetimi yap\u0131lacak olan 21 Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi bulunmaktad\u0131r&#8221; dedi.<\/p>\n<p>Anayasa Mahkemesinin kurulu\u015funun 57\u2019nci y\u0131l d\u00f6n\u00fcm\u00fc d\u00fczenlenen etkinliklerle kutlan\u0131yor. Anayasa Mahkemesi Ba\u015fkan\u0131 Z\u00fcht\u00fc Arslan ve beraberindeki heyetin An\u0131tkabir\u2019i ziyaretiyle ba\u015flayan program, d\u00fczenlenen t\u00f6renle devam etti. Anayasa Mahkemesi Y\u00fcce Divan Salonu\u2019ndaki t\u00f6rene Cumhurba\u015fkan\u0131 Recep Tayyip Erdo\u011fan, Cumhuriyet Halk Partisi (CHP) Genel Ba\u015fkan\u0131 Kemal K\u0131l\u0131\u00e7daro\u011flu, Milli Savunma Bakan\u0131 Hulusi Akar, Adalet Bakan\u0131 Abdulhamit G\u00fcl, Sanayi ve Teknoloji Bakan\u0131 Mustafa Varank, \u00e7ok say\u0131da \u00fcye ile raport\u00f6r kat\u0131ld\u0131.<\/p>\n<p>T\u00f6rende konu\u015fan Anayasa Mahkemesi Ba\u015fkan\u0131 Z\u00fcht\u00fc Arslan, kuruldu\u011fu y\u0131ldan itibaren Anayasa Mahkemesinin g\u00f6rev alan\u0131 bak\u0131m\u0131ndan \u00fc\u00e7 \u00f6nemli evreye ayr\u0131labilece\u011fini ifade ederek, \u201d2012 y\u0131l\u0131na kadar olan birinci evrede Anayasa Mahkemesi esas itibariyle kanunlar\u0131n anayasaya uygunlu\u011funu denetleyen bir y\u00fcksek yarg\u0131 organ\u0131 olarak faaliyet g\u00f6stermi\u015ftir. 2012 y\u0131l\u0131ndan itibaren T\u00fcrk anayasa yarg\u0131s\u0131n\u0131n ikinci evresi ba\u015flam\u0131\u015ft\u0131r. 2010 Anayasa de\u011fi\u015fikli\u011fi, Anayasa Mahkemesinin yap\u0131s\u0131 ve \u00fcye say\u0131s\u0131n\u0131 da de\u011fi\u015ftirecek \u015fekilde bireysel ba\u015fvuru yolunu hukuk sistemine kazand\u0131rm\u0131\u015ft\u0131r. B\u00f6ylece Anayasa Mahkemesinin g\u00f6rev alan\u0131 bireysel ba\u015fvuruyu da i\u00e7ine alarak geni\u015flemi\u015ftir. Esasen bireysel ba\u015fvuru, Anayasa Mahkemesinin sadece g\u00f6rev alan\u0131n\u0131 geni\u015fletmemi\u015f, onun yarg\u0131sal paradigmas\u0131n\u0131 da de\u011fi\u015ftirmi\u015ftir. Anayasa Mahkemesi, bireysel ba\u015fvuruyla birlikte bireyi ve onun temel hak ve h\u00fcrriyetlerini esas alan bir y\u00fcksek yarg\u0131 organ\u0131na d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. Bu paradigma de\u011fi\u015fimi Anayasa Mahkemesinin di\u011fer g\u00f6rev alanlar\u0131ndaki yakla\u015f\u0131m\u0131n\u0131 da etkilemi\u015ftir. Ger\u00e7ekten de Mahkeme bireysel ba\u015fvuruda geli\u015ftirdi\u011fi hak eksenli yakla\u015f\u0131m\u0131n\u0131 norm denetimine de yans\u0131tm\u0131\u015ft\u0131r. Bu etkile\u015fimin en iyi \u00f6rneklerinden biri 27 Aral\u0131k 2018 tarihli iptal karar\u0131nda g\u00f6r\u00fclebilir\u201d dedi.<\/p>\n<p>&#8220;Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin anayasall\u0131k denetimi hayati derecede \u00f6nemlidir&#8221;<\/p>\n<p>&#8220;Anayasa Mahkemesi, 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu\u2019nun 286. maddesinin, istinaf mahkemeleri taraf\u0131ndan ilk defa verilen mahk\u00fbmiyet kararlar\u0131na kar\u015f\u0131 temyiz yolunu kapatan ilgili h\u00fckm\u00fcn\u00fc Anayasa\u2019n\u0131n hak arama h\u00fcrriyetini g\u00fcvenceye alan 36. maddesine ayk\u0131r\u0131 bularak iptal etmi\u015ftir&#8221; diyen Arslan, konu\u015fmas\u0131n\u0131 \u015f\u00f6yle s\u00fcrd\u00fcrd\u00fc:<\/p>\n<p>&#8220;B\u00f6ylece daha \u00f6nceki kararlar\u0131nda h\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131na temkinli yakla\u015fan Mahkeme, bireyin muhtemel yarg\u0131sal hatalar nedeniyle ma\u011fdur edilmesini \u00f6nlemeye y\u00f6nelik, hak eksenli paradigmaya uygun \u00f6nemli bir ad\u0131m atm\u0131\u015ft\u0131r. Anayasa Mahkemesinin bu kararla att\u0131\u011f\u0131 ad\u0131m, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin ayn\u0131 hakla ilgili sa\u011flad\u0131\u011f\u0131 asgari g\u00fcvencenin \u00f6tesine ge\u00e7mi\u015f, bireylere ondan \u00e7ok daha y\u00fcksek bir koruma standard\u0131 sa\u011flam\u0131\u015ft\u0131r. \u00d6te yandan iptal karar\u0131n\u0131n Resm\u00ee Gazete\u2019de yay\u0131nlanmas\u0131ndan \u00e7ok k\u0131sa bir s\u00fcre sonra kanun koyucunun Anayasa\u2019ya ayk\u0131r\u0131l\u0131\u011f\u0131 gidermek i\u00e7in gerekli kanun de\u011fi\u015fikli\u011fini yapm\u0131\u015f olmas\u0131 da memnuniyet vericidir. T\u00fcrk anayasa yarg\u0131s\u0131nda \u00fc\u00e7\u00fcnc\u00fc evrenin, 2017 anayasa de\u011fi\u015fikli\u011fi ile ba\u015flad\u0131\u011f\u0131n\u0131 s\u00f6yleyebiliriz. 9 Temmuz 2018 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren anayasa de\u011fi\u015fikli\u011fiyle Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin anayasall\u0131k denetimi yetkisi Anayasa Mahkemesine verilmi\u015ftir. B\u00f6ylece Anayasa Mahkemesinin g\u00f6rev alan\u0131, yasama i\u015flemlerinin yan\u0131nda, y\u00fcr\u00fctmenin ilk elden d\u00fczenleyici i\u015flemi mahiyetinde olan Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin yarg\u0131sal denetimini de i\u00e7ine alacak \u015fekilde geni\u015fletilmi\u015ftir. 2017 anayasa de\u011fi\u015fikli\u011fi ile benimsenen yeni sistemin en \u00f6nemli kurumu, tabir yerindeyse alamet-i farikas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnameleridir. Bu nedenle Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin anayasall\u0131k denetimi, yeni sistemin \u00fczerine dayanmas\u0131 gereken denetleme ve dengeleme mekanizmas\u0131 bak\u0131m\u0131ndan hayati derecede \u00f6nemlidir. Esasen anayasa de\u011fi\u015fiklikleri ger\u00e7ekle\u015fti\u011fi andan itibaren Mahkememiz konuyla ilgili haz\u0131rl\u0131klara ba\u015flam\u0131\u015f, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnameleri hakk\u0131nda d\u00fc\u015f\u00fcnen ve yazan akademisyenlerin de katk\u0131lar\u0131yla yo\u011fun bir \u00e7al\u0131\u015fma temposu i\u00e7ine girmi\u015ftir. Bu kapsamda bu y\u0131l d\u00fczenlenen sempozyumun konusunu da \u2019Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin hukuki rejimi ve anayasall\u0131k denetimi\u2019 olarak belirledik.&#8221;<\/p>\n<p>\u201cAnayasal sistemimizde Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi yeni bir kurumdur\u201d<\/p>\n<p>Anayasal sistemde Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesinin yeni bir kurum oldu\u011funu ifade eden Arslan, &#8220;Anayasa bu kararnamelere ili\u015fkin temel esaslar\u0131, ilkeleri, s\u0131n\u0131rlar\u0131 ve bunlar\u0131n kanunla ili\u015fkisini d\u00fczenlemi\u015ftir. Anayasa Mahkemesinin g\u00f6revi ise s\u00f6z konusu anayasal h\u00fck\u00fcmleri uygulamak suretiyle \u00f6n\u00fcndeki iptali talep edilen Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin Anayasa\u2019ya uygunluk denetimini ger\u00e7ekle\u015ftirmektir. Anayasa Mahkemesinin bu kararlar\u0131, bir yandan Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin hukuki rejimini a\u00e7\u0131kl\u0131\u011fa kavu\u015fturacak, di\u011fer yandan da yeni h\u00fck\u00fcmet sisteminde yasama, y\u00fcr\u00fctme ve yarg\u0131 organlar\u0131 aras\u0131ndaki ili\u015fkilerin mahiyetine \u00f6nemli \u00f6l\u00e7\u00fcde \u0131\u015f\u0131k tutacakt\u0131r. T\u00fcrk anayasa yarg\u0131s\u0131n\u0131n yukar\u0131da ifade edilen \u00fc\u00e7 evresi, ayn\u0131 zamanda Osmanl\u0131\u2019dan bug\u00fcne devam eden anayasac\u0131l\u0131k hareketlerinin de bir par\u00e7as\u0131d\u0131r. Sened-i \u0130ttifak\u2019la ba\u015flayan ve iki asr\u0131 a\u015fan anayasac\u0131l\u0131k tarihimiz dikkate al\u0131nd\u0131\u011f\u0131nda anayasa kimli\u011fimizde belirli bir s\u00fcreklili\u011fin oldu\u011funu s\u00f6yleyebiliriz. Hi\u00e7 ku\u015fkusuz h\u00fck\u00fcmet sistemi ve y\u00f6netim tekni\u011fine ili\u015fkin baz\u0131 de\u011fi\u015fiklikler, anayasal kimli\u011fi belli \u00f6l\u00e7\u00fcde etkilemi\u015ftir. Ancak bu durum s\u00f6z konusu kimli\u011fin temel esaslar\u0131n\u0131 de\u011fi\u015ftirmemi\u015ftir. Anayasa kimli\u011fimizin en iyi ifade edildi\u011fi yer Anayasa\u2019n\u0131n 2. maddesidir. Buna g\u00f6re insan haklar\u0131, demokrasi, laiklik, sosyal devlet ve hukuk devleti T\u00fcrk anayasa kimli\u011finin temel unsurlar\u0131n\u0131 te\u015fkil etmektedir. Di\u011fer yandan 1876 tarihli Kanunu Esasi\u2019den bu yana devletin b\u00f6l\u00fcnmez b\u00fct\u00fcnl\u00fc\u011f\u00fc de anayasa kimli\u011finin s\u00fcreklilik arzeden bir par\u00e7as\u0131 olmu\u015ftur. Anayasa Mahkemesi verdi\u011fi kararlar \u00fczerinden anayasa koyucunun belirledi\u011fi bu ilkelerin yorumlanmas\u0131, kapsamlar\u0131n\u0131n belirlenmesi ve uygulanmas\u0131 g\u00f6revini yerine getirmektedir\u201d \u015feklinde konu\u015ftu.<\/p>\n<p>&#8220;H\u00e2kim hi\u00e7bir \u015fart ve ahval alt\u0131nda akl\u0131n\u0131 ve vicdan\u0131n\u0131 ba\u015fkas\u0131na emanet edemez&#8221;<\/p>\n<p>Kuvvetler ayr\u0131l\u0131\u011f\u0131n\u0131n hi\u00e7bir \u015fekilde kuvvetler \u00e7at\u0131\u015fmas\u0131 olmad\u0131\u011f\u0131n\u0131 s\u00f6yleyen Arslan, &#8220;Anayasal kimli\u011fimizin temel unsurlar\u0131ndan olan hukuk devleti ve kuvvetler ayr\u0131l\u0131\u011f\u0131, yarg\u0131n\u0131n yasama ve y\u00fcr\u00fctmeden ba\u011f\u0131ms\u0131z olmas\u0131n\u0131 gerektirmektedir. Bu anlamda yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 demokratik hukuk devletinin olmazsa olmaz gereklerindendir. Esasen bu durum t\u00fcm hukuk sistemleri i\u00e7in ve her d\u00f6nemde ge\u00e7erlidir. Di\u011fer yandan son y\u0131llarda ya\u015fad\u0131\u011f\u0131m\u0131z tecr\u00fcbeler, yarg\u0131n\u0131n sadece yasama ve y\u00fcr\u00fctmeye kar\u015f\u0131 de\u011fil ayn\u0131 zamanda her t\u00fcrl\u00fc paralel yap\u0131 ve olu\u015fuma kar\u015f\u0131 da ba\u011f\u0131ms\u0131z olmas\u0131 gerekti\u011fini g\u00f6stermi\u015ftir. H\u00e2kim hi\u00e7bir \u015fart ve ahval alt\u0131nda akl\u0131n\u0131 ve vicdan\u0131n\u0131 ba\u015fkas\u0131na emanet edemez. Tam da bu nedenle Anayasa uyar\u0131nca g\u00f6revlerinde ba\u011f\u0131ms\u0131z ve tarafs\u0131z olan h\u00e2kimler Anayasa\u2019ya, kanuna ve hukuka uygun olarak vicdani kanaatlerine g\u00f6re karar verirler. Bu anayasal h\u00fck\u00fcm ayn\u0131 zamanda yarg\u0131 eti\u011finin evrensel kurallar\u0131ndan birini te\u015fkil etmektedir. Nitekim H\u00e2kimler ve Savc\u0131lar Kurulu taraf\u0131ndan k\u0131sa s\u00fcre \u00f6nce Resm\u00ee Gazete\u2019de yay\u0131nlanan T\u00fcrk Yarg\u0131 Eti\u011fi Bildirgesi\u2019nin 2. maddesi de Anayasa\u2019n\u0131n 138. maddesiyle uyumlu olarak yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 d\u00fczenlemi\u015ftir. Buna g\u00f6re h\u00e2kim ve savc\u0131lar ba\u011f\u0131ms\u0131zl\u0131klar\u0131na do\u011frudan ya da dolayl\u0131 olarak etki edebilecek bask\u0131 ve tesiri kay\u0131ts\u0131z \u015farts\u0131z reddederler\u201d diye konu\u015ftu.<\/p>\n<p>&#8220;Mahkemenin \u00f6n\u00fcnde anayasall\u0131k denetimi yap\u0131lacak olan 21 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi bulunmaktad\u0131r&#8221;<\/p>\n<p>Anayasa Mahkemesinin g\u00f6rev alan\u0131n\u0131n geni\u015flemesinin artan i\u015f y\u00fck\u00fcn\u00fc beraberinde getirdi\u011fini belirten Arslan, ba\u015fvuru ve iptal say\u0131lar\u0131na ili\u015fkin rakamlar\u0131 payla\u015ft\u0131. Arslan \u015funlar\u0131 s\u00f6yledi:<\/p>\n<p>&#8220;Gerek bireysel ba\u015fvuruda, gerekse de norm denetiminde her ge\u00e7en g\u00fcn artan bir i\u015f y\u00fck\u00fcyle kar\u015f\u0131 kar\u015f\u0131yay\u0131z. Bireysel ba\u015fvuruda bug\u00fcn itibariyle derdest ba\u015fvuru say\u0131s\u0131 42 bin civar\u0131ndad\u0131r. Derdest ba\u015fvurular\u0131n y\u00fczde 95\u2019lik k\u0131sm\u0131 2017 y\u0131l\u0131 ve sonras\u0131na aittir. Norm denetiminde ise 76\u2019s\u0131 iptal davas\u0131, 28\u2019i de itiraz ba\u015fvurusu olmak \u00fczere toplam 104 derdest dosya bulunmaktad\u0131r. \u0130ptal davalar\u0131n\u0131n norm denetimi i\u00e7erisindeki oran\u0131 yakla\u015f\u0131k y\u00fczde 73, itiraz ba\u015fvurular\u0131n\u0131n oran\u0131 ise yakla\u015f\u0131k y\u00fczde 27\u2019dir. Bir \u00f6nceki y\u0131l\u0131n istatisti\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda da gelen i\u015fin yar\u0131s\u0131ndan fazlas\u0131 iptal davalar\u0131d\u0131r. Buna kar\u015f\u0131l\u0131k 2017 y\u0131l\u0131nda iptal davalar\u0131n\u0131n norm denetiminde gelen i\u015fe oran\u0131 y\u00fczde 11, itiraz ba\u015fvurusunun ise y\u00fczde 89\u2019dur. \u00d6nceki y\u0131llarda da itiraz ba\u015fvurular\u0131n\u0131n iptal davalar\u0131na g\u00f6re oran\u0131n\u0131n genel olarak hep daha y\u00fcksek oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u015eu halde son iki y\u0131ld\u0131r norm denetiminde iptal davalar\u0131n\u0131n say\u0131s\u0131 \u00e7ok h\u0131zl\u0131 bir y\u00fckseli\u015f g\u00f6stermi\u015ftir. \u00d6te yandan mevcut iptal davalar\u0131n\u0131n yakla\u015f\u0131k y\u00fczde 70\u2019i kanunla\u015fan ola\u011fan\u00fcst\u00fc hal kanun h\u00fckm\u00fcnde kararnameleri ile Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinden olu\u015fmaktad\u0131r. \u015eu anda Mahkemenin \u00f6n\u00fcnde anayasall\u0131k denetimi yap\u0131lacak olan 21 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi bulunmaktad\u0131r. Bu istatistiklerin de ortaya koydu\u011fu \u00fczere \u00f6n\u00fcm\u00fczdeki d\u00f6nemde norm denetiminde verilecek kararlar\u0131n a\u011f\u0131rl\u0131\u011f\u0131n\u0131 kanunla\u015fan OHAL KHK\u2019lar\u0131 ile Cumhurba\u015fkanl\u0131\u011f\u0131 kararnameleri olu\u015fturacakt\u0131r.
