Kamuoyunda \u20191\u2019inci Yarg\u0131 Reformu Paketi\u2019 olarak bilinen kanun teklifi, 17 Ekim\u2019de Meclis\u2019te g\u00f6r\u00fc\u015f\u00fclerek kabul edildi. Bug\u00fcn itibariyle de Resmi Gazete\u2019de yay\u0131nlanarak y\u00fcr\u00fcrl\u00fc\u011fe girdi. Reform paketi kapsam\u0131nda yap\u0131lan de\u011fi\u015fiklikler \u00fczerine Av. U\u011fur Tarhan, de\u011ferlendirmelerde bulundu.<\/p>\n
Reform paketi kapsam\u0131nda 15 farkl\u0131 kanunda toplamda 39 madde de\u011fi\u015fikli\u011fi yap\u0131ld\u0131\u011f\u0131n\u0131 aktaran Av. U\u011fur Tarhan, \u2019\u2019Yap\u0131lan de\u011fi\u015fikliklerle, en az 15 y\u0131l k\u0131demi bulunan avukatlara ye\u015fil pasaport verilmesinin \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015f, avukat ya da noter olabilmek i\u00e7in mesleki yeterlilik s\u0131nav\u0131nda ba\u015far\u0131l\u0131 olma \u015fart\u0131 getirilmi\u015f, tutukluluk s\u00fcresi a\u011f\u0131r ceza mahkemesinin g\u00f6revine girmeyen i\u015fler bak\u0131m\u0131ndan 6 ay, a\u011f\u0131r ceza mahkemesinin g\u00f6revine giren i\u015fler bak\u0131m\u0131ndan ise 1 y\u0131l ile s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r. Bunlar\u0131n yan\u0131 s\u0131ra, ceza yarg\u0131lamas\u0131na hali haz\u0131rda mevcut olan genel yarg\u0131lama usullerinin d\u0131\u015f\u0131nda, seri yarg\u0131lama ve basit yarg\u0131lama olmak \u00fczere iki yeni usul getirilmi\u015ftir\u2019\u2019 \u015feklinde konu\u015ftu.<\/p>\n
\u201cSan\u0131\u011fa verilecek cezada yar\u0131 oran\u0131nda indirim yap\u0131lmas\u0131 m\u00fcmk\u00fcn olabilecek\u2019\u2019<\/p>\n
Av. Tarhan s\u00f6zlerine \u015f\u00f6yle devam etti: \u2019\u2019Seri yarg\u0131lama usul\u00fc, trafik g\u00fcvenli\u011fini tehlikeye sokma, g\u00fcr\u00fclt\u00fcye neden olma, m\u00fch\u00fcr bozma gibi \u00e7e\u015fitli su\u00e7larda uygulanacakt\u0131r. Cumhuriyet Savc\u0131s\u0131\u2019n\u0131n \u015f\u00fcpheliye yapaca\u011f\u0131 teklifin kabul edilmesi sonras\u0131nda Mahkeme taraf\u0131ndan uygulanacak olan seri yarg\u0131lama y\u00f6nteminde duru\u015fma yap\u0131lmaks\u0131z\u0131n h\u00fck\u00fcm verilecektir. Bu y\u00f6ntemin uygulanmas\u0131 halinde san\u0131\u011fa verilecek cezada yar\u0131 oran\u0131nda indirim yap\u0131lmas\u0131 m\u00fcmk\u00fcn olabilecektir\u2019\u2019.<\/p>\n
Basit yarg\u0131lama usul\u00fcn\u00fcn, asliye ceza mahkemelerince adli para cezas\u0131n\u0131 ve\/veya \u00fcst s\u0131n\u0131r\u0131 iki y\u0131l veya daha az s\u00fcreli hapis cezas\u0131n\u0131 gerektiren su\u00e7larda uygulanabilece\u011fini belirten Av. Tahran, \u2019\u2019Basit yarg\u0131lama usul\u00fcnde taraflar\u0131n beyan ve savunmas\u0131 15 g\u00fcn i\u00e7inde yaz\u0131l\u0131 olarak istenecektir. S\u00fcre dolduktan sonra dosya \u00fczerinden yap\u0131lacak inceleme sonucunda \u015fayet cezaya h\u00fckmolunacaksa verilecek cezada d\u00f6rtte bir oran\u0131nda indirim yap\u0131lacakt\u0131r. Basit yarg\u0131lama usul\u00fcnde verilen cezalara kar\u015f\u0131 itiraz yolu a\u00e7\u0131k olacakt\u0131r. T\u00fcrk hukuk sistemi, \u2019\u2019Adalet devletin temelidir\u2019\u2019 anlay\u0131\u015f\u0131n\u0131 esas alm\u0131\u015ft\u0131r. Seri ve basit yarg\u0131lama usul\u00fcne ili\u015fkin yap\u0131lan d\u00fczenleme ile ceza yarg\u0131lamalar\u0131n\u0131n daha h\u0131zl\u0131 ve etkin \u015fekilde sonu\u00e7land\u0131r\u0131lmas\u0131 hedeflenmektedir. Vatanda\u015flar\u0131m\u0131z\u0131n adalet talebini en k\u0131sa zamanda ve en az k\u00fclfetle kar\u015f\u0131lamak i\u00e7in yasay\u0131 uygulayanlar\u0131n \u00fczerine b\u00fcy\u00fck sorumluluk d\u00fc\u015fmektedir. Yasan\u0131n amac\u0131 ile uygulamas\u0131 aras\u0131nda ahenkli bir b\u00fct\u00fcnl\u00fck olu\u015ftu\u011fu takdirde yarg\u0131n\u0131n i\u015fleyi\u015fi daha h\u0131zl\u0131 ve etkin olacakt\u0131r.
