Deveci. \u201cKirac\u0131 \u00f6demesi gereken kira bor\u00e7lar\u0131n\u0131 \u00f6demedi\u011fi takdirde, kiraya veren bu alacaklar\u0131 nas\u0131l tahsil edebilir? Bunun yan\u0131nda kirac\u0131y\u0131 meskenden nas\u0131l \u00e7\u0131kartabilir?\u201d konular\u0131nda \u00f6nemli a\u00e7\u0131klamalarda bulundu.<\/p>\n<p>Avukat Mert Deveci, g\u00fcn\u00fcm\u00fczde en \u00e7ok kar\u015f\u0131m\u0131za \u00e7\u0131kan hukuki sorunlardan biri de kiraya verdi\u011fimiz ta\u015f\u0131nmazlardaki kirac\u0131lar\u0131n kira borcunu vaktinde \u00f6dememesi ve buna ra\u011fmen ta\u015f\u0131nmaz\u0131 tahliye etmemesi oldu\u011funu belirterek \u201cBu durumda ta\u015f\u0131nmaz\u0131n\u0131 kiraya verenler do\u011fal olarak, hem kira alaca\u011f\u0131n\u0131 tahsil etmek, hem de kirac\u0131y\u0131 ta\u015f\u0131nmazdan bir an \u00f6nce tahliye etmek istemektedir. Peki kira borcunun aksat\u0131lmas\u0131 durumunda yap\u0131lacak i\u015flemler nelerdir ? Tahliye s\u00fcreci nas\u0131l i\u015fler ? \u0130\u015fte t\u00fcm bu sorular\u0131n cevaplar\u0131; Ta\u015f\u0131nmaz\u0131n\u0131 kiraya veren ki\u015filer bu ta\u015f\u0131nmaza ili\u015fkin olarak kirac\u0131dan almas\u0131 gereken kira alaca\u011f\u0131n\u0131 alamad\u0131\u011f\u0131 takdirde kira alaca\u011f\u0131n\u0131n tahsili ve kirac\u0131n\u0131n tahliyesi yoluna gidecektir. T\u00fcrk Hukuk sisteminde avukatla temsil zorunlulu\u011fu olmamas\u0131na ra\u011fmen bu konuda alan\u0131nda uzman bir avukattan yard\u0131m al\u0131nmas\u0131 tavsiye edilmektedir. Bununla beraber bu makale sayesinde okuyucular\u0131m\u0131z en az\u0131ndan i\u015fleyi\u015f  hakk\u0131nda bilgi sahibi olacakt\u0131r.\u201d<\/p>\n<p>Kira bedelinin \u00f6denmemesi halinde kiralayan do\u011frudan icra dairesi arac\u0131l\u0131\u011f\u0131yla ta\u015f\u0131nmaz\u0131n tahliyesi yoluna gidebilece\u011fini anlatan Avukat Mert Deveci, \u201cKirac\u0131 kira bedelini \u00f6demedi\u011fi takdirde, kiralayan \u00f6denmeyen kira bedellerini icra dairesi arac\u0131l\u0131\u011f\u0131yla g\u00f6nderece\u011fi, para borcunun ifas\u0131n\u0131 i\u00e7erir \u00f6deme emriyle isteyebilir. \u00d6deme emrinde 7 g\u00fcn (6 aydan k\u0131sa kira s\u00f6zle\u015fmelerinde 3 g\u00fcn) i\u00e7inde itiraz edilebilece\u011fi, 30 g\u00fcn i\u00e7inde (h\u00e2s\u0131lat kiras\u0131nda 60 g\u00fcn) \u00f6deme yap\u0131lmas\u0131 gerekti\u011fi belirtilir. \u0130tiraz kirac\u0131 taraf\u0131ndan s\u00fcresinde yap\u0131lmaz, 30 g\u00fcn i\u00e7erisinde de \u00f6deme yap\u0131lmazsa kira alaca\u011f\u0131 kesinle\u015fir ve kiralayan (alacakl\u0131) icra mahkemesinden bor\u00e7lunun ta\u015f\u0131nmazdan tahliyesini isteyebilecektir. Takibin kesinle\u015fmesiyle kiralayan, icra mahkemesi nezdinde kirac\u0131n\u0131n ta\u015f\u0131nmazdan tahliye edilmesine karar verilmesi i\u00e7in dava a\u00e7ar.<\/p>\n<p>Kiraya verenin ilams\u0131z tahliye takibi yapabilmesi i\u00e7in yaz\u0131l\u0131 bir kira s\u00f6zle\u015fmesi \u015fart de\u011fildir. Zira kira akdi s\u00f6zl\u00fc olarak da yap\u0131labilir. S\u00f6zl\u00fc kira s\u00f6zle\u015fmesinin dayanak oldu\u011fu icra takibinde kendisine \u00f6deme emri gelen kirac\u0131, s\u00fcresi i\u00e7erisinde kira akdine, ayl\u0131k kira bedeline a\u00e7\u0131k ve kesin olarak itiraz etmezse kira akdini ve ayl\u0131k kira bedelini kabul etmi\u015f say\u0131lacakt\u0131r. Tahliye talepli icra takibinden sonra kirac\u0131ya g\u00f6nderilen \u00f6deme emrinin kirac\u0131ya tebli\u011f edilmesiyle yukar\u0131da belirtmi\u015f oldu\u011fumuz s\u00fcreler ba\u015flayaca\u011f\u0131ndan kirac\u0131ya yap\u0131lan tebligat\u0131n dikkatli bir \u015fekilde incelenmesi, tebligat\u0131n usul\u00fcne uygun oldu\u011funun kontrol edilmesi gerekecektir. Bu suretle icra hukuk mahkemeleri nezdinde tahliye davas\u0131 a\u00e7man\u0131n yolu a\u00e7\u0131lacakt\u0131r\u201d diye konu\u015ftu.<\/p>\n<p>Avukat Mert Deveci, kiraya veren ile kirac\u0131 aras\u0131nda yaz\u0131l\u0131 veya s\u00f6zl\u00fc kira s\u00f6zle\u015fmesi olmas\u0131na ra\u011fmen, kirac\u0131 kira bedelini \u00f6demedi\u011fi halde kira borcunu \u00f6dedi\u011finden bahisle haks\u0131z yere \u00f6deme emrine itirazda bulunursa, kiraya veren icra mahkemesi nezdinde itiraz\u0131n kald\u0131r\u0131lmas\u0131 ve tahliye talep edebilece\u011fini ifade ederek, \u201cBu davada ispat y\u00fck\u00fc kira bedellerini \u00f6dedi\u011fini iddia eden bor\u00e7lu kirac\u0131ya d\u00fc\u015fecektir. Kira bedelini \u00f6dedi\u011fini ispat edemeyen kirac\u0131 hem davay\u0131 kaybedecek hem de haks\u0131z itiraz\u0131ndan kaynakl\u0131 olarak alaca\u011f\u0131n y\u00fczde yirmisinden a\u015fa\u011f\u0131 olmamak \u00fczere icra inkar tazminat\u0131na mahkum edilecektir.<\/p>\n<p>S\u00f6z konusu davalarda yetkili mahkeme kiralanan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesidir. Mahkemenin yetkisi kesin yetki olup, mahkemece bu husus resen nazara al\u0131naca\u011f\u0131ndan, davan\u0131n yetkili mahkemede a\u00e7\u0131lmas\u0131na son derece dikkat edilmelidir. Tahliye karar\u0131n\u0131n icraya konulabilmesi i\u00e7in karar\u0131n kesinle\u015fmesine ve istinaf mahkemesi taraf\u0131ndan onanmas\u0131na gerek yoktur. Kirac\u0131n\u0131n tahliyesi i\u00e7in icra mahkemesi taraf\u0131ndan verilen tahliye karar\u0131n\u0131n kirac\u0131ya tefhimi (duru\u015fma s\u0131ras\u0131nda karar\u0131n y\u00fcze kar\u015f\u0131 okunmas\u0131) veya duru\u015fmada yer almam\u0131\u015fsa kendisine tebli\u011fi tarihinden itibaren 10 g\u00fcnl\u00fck s\u00fcrenin ge\u00e7mesi yeterlidir.
