Bursa 1. \u0130dare Mahkemesi, B\u00fcy\u00fck\u015fehir Belediyesi\u2019nin t\u00e2dilen plan de\u011fi\u015fikli\u011fi yapma yetkisinin bulunmad\u0131\u011f\u0131, “belediye hizmet alan\u0131” olarak belirlenen alan\u0131n tamamen kald\u0131r\u0131ld\u0131\u011f\u0131 gerek\u00e7esiyle a\u00e7\u0131lan davada Mudanya Belediyesi\u2019ni hakl\u0131 buldu.<\/p>\n

Bursa B\u00fcy\u00fck\u015fehir Belediyesi,Kumyaka Mahallesinde Mudanya Belediyesi Meclisi taraf\u0131ndan uygun bulunmayan plan de\u011fi\u015fikli\u011finin uygun oldu\u011fu \u015feklinde karar alm\u0131\u015f, Mudanya Belediyesi de konuyu yarg\u0131ya ta\u015f\u0131m\u0131\u015ft\u0131. Bursa B\u00fcy\u00fck\u015fehir Belediye Meclisi\u2019nin 22.11.2018 tarihli karar\u0131n\u0131n hukuka ayk\u0131r\u0131 oldu\u011fu, Bursa B\u00fcy\u00fck\u015fehir Belediyesi\u2019nin t\u00e2dilen plan de\u011fi\u015fikli\u011fi yapma yetkisinin bulunmad\u0131\u011f\u0131, “belediye hizmet alan\u0131” olarak belirlenen alan\u0131n tamamen kald\u0131r\u0131ld\u0131\u011f\u0131 gerek\u00e7esiyle a\u00e7\u0131lan davada mahkeme Mudanya Belediyesi\u2019ni hakl\u0131 buldu.<\/p>\n

dava konusu karar\u0131nda hukuka uygunluk bulunmad\u0131\u011f\u0131 sonucuna var\u0131lmaktad\u0131r\u201d diyerek, y\u00fcr\u00fctmeyi durdurma ve ipt\u00e2l karar\u0131 verdi.<\/p>\n
Karar\u0131 de\u011ferlendiren Mudanya Belediye Ba\u015fkan\u0131 Hayri T\u00fcrky\u0131lmaz, B\u00fcy\u00fck\u015fehir Belediyesi\u2019nin \u201cben yapt\u0131m oldu\u201d mant\u0131\u011f\u0131na kar\u015f\u0131 bir hukuk zaferi daha elde ettiklerini belirterek, \u201cBelediyemize ait hizmet alan\u0131nda onay vermemi\u015f olmam\u0131za ra\u011fmen al\u0131nan karar\u0131n yanl\u0131\u015fl\u0131\u011f\u0131 mahkeme taraf\u0131ndan da kabul edilmi\u015ftir. B\u00fcy\u00fck\u015fehir\u2019i \u00f6ncelikle il\u00e7emiz genelinde yetki ve sorumluluklar\u0131n\u0131 yerine getirmeye, sonras\u0131nda da kanunlara sayg\u0131l\u0131 olmaya davet ediyorum.
