Samanda\u011f 2. Asliye Hukuk Mahkemesine m\u00fcracaat eden bir vatanda\u015f, kom\u015fusunun dairesine takt\u0131rd\u0131\u011f\u0131 g\u00fcvenlik kameras\u0131n\u0131n a\u00e7\u0131s\u0131n\u0131n kendi evinin penceresi ve avlusunu g\u00f6r\u00fcnt\u00fcledi\u011fini \u00f6ne s\u00fcrd\u00fc. Davac\u0131 vatanda\u015f, \u00fcst katta oturan daval\u0131n\u0131n evin giri\u015fine, avlusuna, merdiven k\u0131sm\u0131na ve balkonuna kamera koydu\u011funu s\u00f6yledi. Kameralar\u0131n kendi evinin giri\u015f kap\u0131s\u0131 ve pencerelerine y\u00f6neltilerek kay\u0131t i\u015flemi yap\u0131ld\u0131\u011f\u0131n\u0131, \u00f6zel hayat\u0131n gizlili\u011finin ihlal edildi\u011fini belirten vatanda\u015f, kameralar\u0131n kald\u0131r\u0131lmas\u0131na karar verilmesini talep etti. Mahkemede savunma yapan daval\u0131 kom\u015fu ise, kameralar\u0131 g\u00fcvenlik i\u00e7in takt\u0131rd\u0131\u011f\u0131n\u0131 belirterek, davan\u0131n reddini talep etti.<\/p>\n

Mahkeme, davan\u0131n kabul\u00fcne ve m\u00fcdahalenin \u00f6nlenmesine, bilirki\u015fi raporunda yerleri belirtilen 2, 3, 4, 5 numaral\u0131 kameralar\u0131n s\u00f6k\u00fclmesine karar verdi. Karar\u0131n daval\u0131 taraf\u0131ndan temyiz edilmesi \u00fczerine davay\u0131 g\u00f6r\u00fc\u015fen Yarg\u0131tay 14. Hukuk Dairesi, emsal nitelikte bir karara imza att\u0131. Daire, mahkeme karar\u0131nda yasaya ayk\u0131r\u0131l\u0131k g\u00f6r\u00fclmedi\u011fini belirterek, karar\u0131n onanmas\u0131na h\u00fckmetti. Kararla birlikte g\u00fcvenlik amac\u0131yla tak\u0131lan kameralar, a\u00e7\u0131s\u0131 kom\u015funun evini g\u00f6rmeyecek \u015fekilde tak\u0131lacak.
